Booking & Service Terms

These terms are entered into by Ndalaku Amobi, trading as Ndalicious (ABN: 48 274 060 452), referred to in these terms as “Ndalicious”.

“Client” means the individual or entity named on the relevant quote and invoice issued by Ndalicious for the booking to which these terms apply.

“Venue” means the location specified on the relevant quote for the booking, being the address at which Ndalicious will deliver, set up, and/or serve the food covered by that quote. Any change of Venue must be agreed in writing and may affect the quoted price.

1. Booking and Payment (Catering)

Confirmation

A catering booking is not confirmed until a non-refundable deposit of 50% of the total quoted amount has been received. Until that point, the date remains available to other clients.

Payment schedule (Catering)

Failure to pay the balance by the due date may result in cancellation of the catering booking, with the deposit forfeited.

Accepted payment methods

Bank transfer (BSB and account number provided on invoice). Payment is considered received when funds clear in the Ndalicious account.

These amounts represent genuine pre-estimated losses, including ingredient procurement, labour already performed, and lost booking opportunity for the catering booking.

Date changes (Catering)

The confirmed event date for a catering booking is fixed. If the client needs to change the date, the cancellation terms above apply and a new booking will need to be made.

1a. Cake-Only Orders

This section applies to cake-only orders placed through the dedicated cakes enquiry page, not to cakes included as part of a full catering booking, which remain subject to Section 1 above.

Cake-only orders are treated as a product purchase. No deposit is required to confirm the order. Full payment is invoiced 7 days ahead of the delivery or collection date.

If you need to cancel, notify Ndalicious at least 48 hours before the scheduled delivery or collection for a 50% refund. Cancellations with less than 48 hours' notice are not eligible for a refund, as ingredients and production are already committed by that point.

2. Final Headcount and Menu Changes (Catering)

A confirmed headcount and final menu must be provided no later than 14 days before the event. This is the cutoff for ingredient procurement and production planning.

After that cutoff

Menu changes after the 14-day cutoff will be accommodated where possible but cannot be guaranteed, and may attract an additional charge if they require new ingredients or additional preparation time.

3. Dietary Requirements and Allergens

Ndalicious prepares food in a home kitchen that handles the following allergens: peanuts, tree nuts, milk, eggs, sesame, fish, crustacea, soy, gluten-containing cereals (wheat, rye, barley, oats), and lupin. This kitchen is not allergen-free and cannot guarantee the absence of cross-contamination.

Client responsibility

Clients are responsible for communicating all dietary requirements, allergies and severity of reactions at the time of booking, and no later than 14 days before the event. Ndalicious will make reasonable accommodations where possible and will provide an ingredient list where requested.

Severe allergies

For guests with severe or anaphylactic allergies, the client must arrange a separate, dedicated allergen-safe product from a certified allergen-free facility. Ndalicious cannot accept liability for allergic reactions where this instruction has not been followed.

Cakes and Catering

Menus are designed with dietary requirements in mind. However, dishes are prepared in shared equipment and in close proximity to other ingredients. Ndalicious will clearly disclose allergen ingredients but cannot guarantee the absence of trace allergens.

4. Event Day Logistics

Delivery

Delivery windows are confirmed in writing at least 48 hours before the event. A delivery window is typically 30 minutes. If Ndalicious is delayed beyond that window due to circumstances within our control, we will communicate proactively. Ndalicious is not liable for any delays outside of our control.

Venue access

The client is responsible for ensuring (1) all consents and authorities required for delivery and set up have been obtained and (2) venue access is available at the agreed delivery time. If access is delayed by more than 30 minutes through no fault of Ndalicious, a $50 holding fee may apply.

If Ndalicious is unable to deliver due to venue inaccessibility and cannot return within the event window, no refund will be issued.

Outdoor and weather contingencies

For outdoor events, the client is responsible for providing a suitable covered or shaded area for food setup. Ndalicious is not liable for food quality or safety where appropriate conditions are not provided. In the event of extreme weather that makes safe delivery or setup impossible, Ndalicious will work with the client to find a solution, but cannot guarantee a refund if production is already complete.

What's included

Delivery and setup of food in the agreed presentation format (e.g. boards, platters, stands, grazing boxes, cake on a cake board) are included in the quoted price unless otherwise stated. Styling, props, floral arrangements, and venue decoration are not included unless explicitly quoted.

Equipment

Where Ndalicious provides boards, platters, stands, or display items, these remain the property of Ndalicious and must be made available for collection within the agreed timeframe (see Section 5).

5. Equipment and Collection

The client is responsible for the pack down and clean up of all items. Where reusable equipment is provided (boards, platters, stands, display items), the client is responsible for its safekeeping until collected by Ndalicious. Collection will be arranged within a timeframe agreed before the event.

If items are damaged, lost, or not made available for collection within the agreed window, the replacement cost will be invoiced to the client. Ndalicious will provide reasonable evidence of the replacement cost on request.

6. Client Communication

Enquiries and consultations

Initial enquiries are responded to within 2 business days. A free pre-booking consultation of up to 20 minutes (phone or video) is included for all new clients. Additional consultation time, concept development, or bespoke menu planning beyond the initial discussion may be charged at $75 per hour, and will be communicated to the client before it is undertaken.

Quote revisions

Each quote includes up to two rounds of revision. Further revisions may be charged at $75 per hour. A revision is defined as a change to guest numbers, menu items, dietary requirements, or service scope. Minor clarifications are not counted as revisions.

Booking confirmation

Written confirmation (via email or SMS) of the deposit receipt constitutes a confirmed booking. Verbal agreements are not binding.

7. Photography and Intellectual Property

Ndalicious reserves the right to photograph all food and setups produced for client events for use on our website, social media, and promotional materials. Photos will not identify guests or include identifiable images of children without explicit written consent from the client or relevant parent/guardian.

If a client does not wish for their event to be photographed for promotional purposes, they must notify Ndalicious in writing at the time of booking.

All recipes, menus, and food concepts created by Ndalicious remain the intellectual property of Ndalicious and may not be reproduced or shared without written permission.

Client content

If a client shares photos of Ndalicious food or products publicly, Ndalicious appreciates being credited as @ndalicious_ on Instagram. This is not a legal requirement but is welcomed.

8. Liability

To the extent permitted by Australian Consumer Law, Ndalicious's total liability for any claim arising from a booking is limited to the total amount paid by the client for that booking.

Nothing in these terms excludes any right or guarantee that cannot be excluded under Australian Consumer Law, including guarantees relating to the supply of services.

9. Governing Law

These terms are governed by the laws of New South Wales, Australia.
